    Apples and oranges. If I break into a business (illegally) can I sue them for falling on a slippery floor? My status of legal presence is the primary issue. As has been pointed out, these "visitors" are not subject to conscription, jury duty, income tax, or any of the myriad other laws of citizenship. Again, and as always, these groups want all the "goodies", but none of the responsibilities.

    Every Republican who hasn't filed articles of impeachment against Trump or resigned is complicit in these deaths. They know his true nature and some of them opposed his nomination. They cowardly backed down so they could hide behind a sadistic traitorous jackass and use him as a distraction. Many of us saw this coming. Many of us understand the sadistic nature of Donald Trump and the danger that presents to our communities and Country.

    The Republican party does not get a free pass on this. Forget about Trump and concentrate on removing every Republican from office as fast as humanly possible. Either through legal actions against their corruption or by voting them out. Let's not make the same mistake that Germany did when they elected a nationalist, a man of the people, to run their country.

    Where in the 14th does it indicate in any way, that the fact that the child is born in the United States, the parents are entitled to residency? They can leave with the child until he is an adult, at which time he could claim his citizenship, or the could give up their legal custody.

    The Supreme Court should not don't look at what the general tradition or practice has been if this practice is legally incorrect. Or whether a policy seems "good" in their opinion. But they do look at the language of the Constitution, legal precedent via other Supreme Court cases, and the legislative intent behind a Constitutional Amendment. To say it can't be done because people have assumed the meaning of the 14th incorrectly or statutes have been passed thereafter is pessimistic and incorrect.

    The first half of our 14th Amendment is not referring to illegal immigrants or their children being born here whatsoever! It is plainly covering legal U.S. born citizens. That we are subject to our own jurisdiction. In other words, laws vary from state to state. For example smoking: is not allowed in any public facilities in some states. While other states have no smoking prohibitions. Some counties vary from one another within the same state. For example leash laws: some counties in your state may allow dogs to run loose. The 14th Amendments was for slaves to assure their citizenship, 3 years after the Civil War.     The responsibility of the POTUS is to enforce the Constitution. If he feels that that the various levels of government are not properly enforcing the Constitution, he has the right to make sure that it is enforced as intended. This would not be a change to the 14th. The EO would serve to ensure 'enforcement' of the 14th.

    Senator Jacob Howard, the man who worked with Lincoln in authoring the 14th, Senator Lyman Trumbull, the author of the 13th also inserted additional provisions into the 14th that clearly defines the meaning of 'jurisdiction'.

    Do you think the SCOTUS will use Websters Dictionary for the definition or 'jurisdiction' or do you think the SCOTUS will base their ruling off the recorded definition by the authors of the 14th? I believe Trump's play here is that he expects his EO to be challenged in the courts forcing the interpretation of the 14th into the halls of the SCOTUS and if the SCOTUS rules the way it was intended defined by Senators Howard and Trumbull, the loopholes are closed forever lasting way beyond his Presidency. It's brilliant.

    Aliens and illegal aliens are STILL under their countries jurisdiction until they denounce their loyalty to their country, and that has to be done by legal naturalization and swearing loyalty to the usa. Then and only then will their children become American citizens. If they do not go tru legal channels, their are still sworn citizens of their country, which is part two of the 14th amendment. Under jurisdiction and allegiance of their home country. Get in line, and your kids birthright is not legal.

    I don't think that "subject to the jurisdiction there of" really means anything in the case of a newborn.

    Here's a simple thought experiment. A baby is born within the United States then abandon at a Church, Hospital, Fire House, Police Station etc. Sadly this happens all the time. Often the baby is left outside without an adult in the cold and we know nothing about it except that the crime of child endangerment has been committed.

    If we have no idea if a citizen or alien abandoned this baby then is the baby a citizen? If DNA shows it has "Peruvian Indian ancestors" like Elizabeth Warren, then is the baby an American citizen which could have been possibly born to irresponsible hispanic Americans or do we just assume it was born to illegals and send it back (where we don't know)?

    On the other hand, suppose the baby dies from exposure and within days the police find out that it is the child of reckless illegal aliens who meant well but killed the baby. Do we prosecute the aliens for child endangerment and manslaughter, or just deport them since they're not under jurisdiction?

    To me it sounds like anyone born here is a citizen, however if either of their parents are citizens then that parent/s should not receive welfare or aid and must be deported. If they love their kid they'll take their kid with them, if not then they can put the kid up for adoption.

    SCOTUS will strike it down. An amendment requires 2/3 of congress- won't ever happen. Even if it does happen, you would anger many countries by forcing them to take in American citizens. You would have to round up millions of American citizens who are armed. The court system would be completely tied up with all kinds of cases. ICE would be overwhelmed.

The 14th Amendment was specifically created as a constitutional commitment by Abraham Lincoln, and the house of representatives, under the rule of law, that in 1863 all African Americans, ( Slaves ) descendents of " Slaves" should be free and their newly born children, will have birthright citizenship recognized, by the United States government. This constitutional right, was not an umbrella for Indian native Americans, Asians, Mexicans, Indians, or any other groups, including migrating Africans.     The phrase "birthright citizenship" does not appear, in the Constitution. The 14th Amendment was passed to assure that freed slaves were not believed not to be citizens, and to assure they were not deprived of the rights, of citizens. "Subject to the jurisdiction of" makes it rather clear that anyone born to citizens of other countries are not included. I would not wish to see the issue go to the Supreme Court. It would be better addressed by a possibly longer and more easily interpreted article. The august body we call the Supreme Court has come up with some of the screwiest decisions imaginable. Yes, some good ones, but some very bad ones. An Article 5, convention of States is the only solution. Counting on Congress to present a sensible Constitutional amendment, for ratification, by the States, is just silly.

    The purpose and intent of the 14th Amendment was to reverse the “Dred Scott vs. Sandford decision of 1857” and did nothing more than this. It was about granting citizenship to freed African slaves. The 14th Amendment gave naturalize citizenships to all freed African slaves and their children are natural born United States citizens. Under the 14th Amendment only naturalized or natural born United States citizens parents can have children that have birthright citizenships.

    This is very much a constitutional edit issue so it's not up for debate by the supreme court. The only thing Trump could actually do is tell Republicans in both houses of Congress to vote and amend that amendment. In order for that to pass, I believe you need 2/3 majority in both chambers. Even if it passes, it has to go to the states and there will be states who will say no. In order for it to pass it needs all 50 states to agree.

    What Trump is actually talking about is very different than what people think he is saying. First of all, the President cannot change the Constitution by Executive Order. It cannot be done. But what the President can do via Executive Order is to correct the false and erroneous interpretation of the 14th amendment that is giving US citizenship to children of parents who are not US citizens. This is what Trump is no doubt talking about, and this is something he really can do through an EO.

    I think at the very least, babies of people who are here on tourists visas as well as illegal immigrants should not be given birthright citizenship. I married a naturalized citizen who had family members visiting on a tourist visas several years ago. A female relative had a child here, and even though they had the money to pay the hospital bill, they used Medicaid. I happened to pregnant at the same time, I worked to buy everything my child needed (excluding my baby shower gifts) – not my husband. They helped themselves to all my baby’s’ belongings (from crib, pack and play, bassinet, car seat, stroller, and more) when their child arrived early, much to my chagrin and outright outrage when they refused to return it. I had to purchase everything again, the only thing my husband bought was a $15 stroller. I also had to pay my own hospital bill. So when she came here to have the second child, concealing her pregnancy from immigration, I called ICE to let them know she was 7 months pregnant and coming here to have her child on Medicaid, they gave her a 2 week visa!! Also, guess who has been living with us for the past 2 years going to high school here? The first child that was born! I was never consulted, asked, or considered in that decision either, but she’s been my responsibility alone. I’m currently in the process of my 5th and final attempt at divorcing my scum bag husband. I’ll leave with the clothes on my back if I need to.

Have more babies and now your living good off the American taxpayers even though you never paid into the system. They know that, so they will continue to come.
