Lack of Courtesy with the Messenger of Allah ﷺ BY: His eminence, the erudite Imam,
Shaykh Ṣalāḥ al-Dīn at-Tijānī al-Ḥasanī Lack of Courtesy (su’ al-‘adab) with
the Messenger of Allah ﷺ. I seek refuge from the expelled Satan,
In the Name of Allah, Ar-Rahman, Ar-Raheem “The meed of those who wage war against
Allah ﷻ and His apostle ﷺ and go about in the land corrupting
is only that they shall be slain or crucified or their hands and feet be cut off
on the opposite sides or be banished from the land”
[Quran 5:33] Can anyone really wage war against our Lord ﷻ? Such are the ignorant ones. Can anyone really wage war
against the Prophet ﷺ? They (just) assume so. Why does the one who wages war do so?
To appropriate or seize the rights of another. Yes or no? So they are waging war against our Lord ﷻ
through usurping His right ﷻ of legislating Enacting the law (shar`) is whose right? No, they want to seize that.
(To give themselves the right to make laws ) this is – as if – they are waging war (against Him ﷻ) As for the Messenger of Allah ﷺ, they did
indeed wage war against him ﷺ when he ﷺ was living amongst them
in Makkah and al-Madinah They fought him ﷺ using all means necessary
(including swords, arrows, … etc.) Then after he ﷺ passed on,
(to the Next Life) The war against him ﷺ changed
from war using swords, to war through the lack of courtesy. Any form of lack of courtesy towards the
Messenger of Allah ﷺ is a form of war, a war waged against Allah ﷻ and His Messenger ﷺ. For example, anyone who says “There is no such thing as the Sunnah,
we should just follow the Quran” Such person is a combatant (muharib – مُحَارِب)
who deserves the legal punishment of Hirābah. This is a man who is basically saying, “There is no God but Allah, and there is no (such a thing as) Muhammad is the Messenger of Allah” He says, “We don’t want Sunnah”. This means ?
“There is no Muhammad ﷺ” Because Allah ﷻ deputized the Prophet ﷺ, “And whatever
the Messenger has given you – take”, [Quran 59:7] i.e. an authority to enact laws (tashri`). From where did you get that a prayer is made
of 3 or 4 rak`ahs? If not from the Sunnah. How did you know about the prescribed figures of
Zakah, or about the rituals of Hajj? No one should say .. The one who says, “There is no Sunnah”,
or fights against it is actually waging war against Allah ﷻ and His Messenger ﷺ, and should be punished. The Prophet ﷺ did so. Lack of courtesy with the Prophet ﷺ
calls for the legal punishment of Hirābah A man named al-Hakam ibn Abi al-‘As al-Hakam was the father of Marawan ibn al-Hakam
(the fourth Umayyad Caliph) who, in turn, was the father of Abd al-Malik ibn Marwan
(the 5th Umayyad caliph) Al-Hakam (ibn Abi al-‘As),
lived in al-Madinah with the Prophet ﷺ but he was a hypocrite The Prophet ﷺ used to have a unique style of walking
(no one walked in the same manner) and that man used to make fun of the way
the Prophet ﷺ walked (and used to) mockingly imitates it. One time, the Prophet ﷺ was walking, and
(al-Hakam) walking behind him making fun of him ﷺ. The Prophet ﷺ turned to him and found him
poking fun at him ﷺ, so he ﷺ banished him (from al-Madinah)
to al-Ta’if (south east of Makkah) “Banishing him” means that he ﷺ applied
the legal punishment of Hirābah “or be banished from the land”, [Quran 5:33] You execute the legal punishment of Hirābah
according to the degree of infraction i.e. if the one who commits hirabah (mohareb) or
highway robbery, kills someone, we kill him. if he robs (with violence or grand larceny)
we amputate his limbs. If he killed so many people,
we crucify him (till death). So anyone who mocks the Messenger of Allah ﷺ, or of his way ﷺ (Sunnah), we establish the penalty
of Hirābah according to the degree of his mockery. So no one should declare,
“The Quran is sufficient for us” And no one can say, “We must (emend the Sunnah)
or just take parts of it” “Just take what is 100% correct” This is a form of derision.
The Prophet ﷺ established the deterrent and the way to emend the Hadith.
He ﷺ stated a rule, “He who deliberately forges a lie against me let him
have his abode in the Hell”, [Bukhari, Muslim]. Is that a deterrent or not?
There is also (what we call) an incentive. e.g. in the case of our master Ma`iz
when he committed adultery, he came forward by himself and confessed.
So he had that (inner) incentive (to do so) but some people cannot be left for (their inner)
incentives, e.g. al-Muharibun (pl. of mohareb). with such people, nothing works
except deterrents or threats. So Allah ﷻ revealed, “The meed of those who wage war
against Allah ﷻ and His apostle ﷺ …..”, [Quran 5:33] Do we debate with them? No.
There is no debate (or arguments here). What you watch on TV (channels) is
a form of bad manners All of it are bad manners. What do we do with them?
“Indeed, the penalty for those who wage
war against Allah and His Messenger and strive upon earth [to cause] corruption is none but
that they be killed or crucified or that their hands …. or that they be exiled from the land” None of these options include arguing with them.
Argue about what?! Someone tells, “There is no such thing as Sunnah”.
What is there to argue with him about? And the amazing thing for that such people
(i.e. al-Muharibun), for example, when one violates any rule that calls for a legal
punishment (had), and we carried on that punishment, these punishments are expiation for the wrong they did
(i.e. they are forgiven) e.g. for the one who killed, if we kill him,
then his sin is atoned for. for the one who commits adultery, if we stone him,
then his sin is wiped, except these people (who commits Hirābah).
Their punishment does not fully absolve them. “That is for them a disgrace in this world; and for them
in the Hereafter is a great punishment”, [Quran 5:33] i.e. (they will have to face) the two punishments:
one in this life, and another in the Hereafter. There is no expiation for them. “and for them in the Hereafter is a great punishment”. That great punishment is the one
that touches the soul (nafs) along with the body. Some people in the Fire are (called)
‘The Folk of the Fire” i.e. some people will enter the Fire, according to the Hadith. We seek refuge with Allah from the Fire. They enter it (as a result of some) major sins
that they committed. Such people will taste death.
Once they enter the Fire, they die. And they won’t feel much afterwards.
i.e. enough for them the terror they felt. and then they will be taken out (of the Fire,
and admitted to) Jannah. But these (Muharibun) will have a great punishment i.e. not like (the former group) who will die.
No they will have to endure the punishment. People think that the punishment for Hirābah is
